Hyundai to Pay Fla. Dealer $3.3M in Retaliation Case

Automotive News reports Hyundai Motor America has been ordered to pay a multimillion-dollar award to Universal Hyundai of Orlando, Fla., for breaching Universal’s franchise agreement as well as Florida’s Dealer Act.

Universal Hyundai’s owners alleged unfair allocation practices by the factory, citing new vehicle inventories of about half the regional average. The complaint followed an earlier suit that resulted in a $16 million award — and the two may have been related, according to AN’s Eric Freedman.

“The reason, the lawsuit alleged, was Hyundai’s retaliation for a 2018 suit brought by Universal alleging breach of contract and breach of the covenant of good faith and fair dealing for failing to provide the right of first refusal to select two Genesis franchises in a specified geographic area,” Freedman writes.
