N.J. Infiniti Dealer Accuses Nissan of Strong-Arm Tactics in Counterclaim

In a counterclaim, attorneys representing Infiniti of Englewood (N.J.) say an out-of-trust lawsuit filed by Nissan against the dealership is “an attempt to strong-arm” ownership as it negotiates a floorplan financing agreement with Infiniti Financial Services.
The lawsuit was filed March 27 and the counterclaim was filed last month, according to Automotive News reporter Eric Freedman, who notes the dealership had already parted ways with its former floorplan lender, Keystone Auto Lending, when Nissan took legal action.
“Negotiations stopped when the lawsuit was filed, but the dealership is inquiring whether Infiniti Financial Services is still willing to provide financing as originally planned,” Freedman writes. “The store is currently not purchasing new vehicles from Nissan.”
